A Proposta de Emenda Constitucional 159/2019, a PEC da Bengala, de autoria da Deputada Bia Kicis (PSL DF), prevê fixar a idade limite de 70 anos para aposentadoria compulsória dos servidores públicos, reduzindo em cinco anos como é hoje. Em entrevista ao jornal O Globo, de 26 de novembro último, o presidente do Supremo Tribunal Federal, Luiz Fux, disse que “a proposta viola a harmonia entre os Poderes”.

Pelas palavras do ministro Fux, dá-se a entender, então, que há de se respeitar uma harmonia de natureza hierárquica entre os Poderes, em que o STF representa o comando geral, uma vez que ele não está levando em conta a competência soberana do Congresso de decidir criar ou modificar qualquer lei de abrangência nacional.

Uma declaração no mínimo infeliz a do presidente do Supremo, formulada por um raciocínio estranho à previsão constitucional de independência dos três pilares da República. Não bastasse a desastrosa declaração, para não dizer ‘golpista’ do também ministro do STF, Dias Toffoli, em Live apenas com esquerdistas, em que afirmou que o Brasil já vive, na prática, um regime “semipresidencialista, com o Supremo no papel de “Poder Moderador”, usando a Pandemia como desculpa.

O outro colega de casa, senhor Alexandre de Moraes, segue em sua cruzada de levar adiante um processo inconstitucional, onde ele se coloca como vítima, delegado, advogado de acusação e juiz do caso, e que prende deputado, presidente de partido, e jornalistas, sob a acusação de atos “antidemocráticos” e divulgação de “Fake News”, baseado em leis inexistentes. Há inclusive, um ministro do Supremo Tribunal Eleitoral que desmonetizou as contas de youtubers conservadores. 

Poderia relatar muito mais casos de abusos cometidos pela suprema corte de justiça brasileira, mas meu intuito não é cansar os leitores com esse artigo, mas dá uma ideia do que tem acontecido no nosso país, ultimamente. Pois, se há uma ditadura em voga no Brasil, essa não é exercida por Jair Bolsonaro. 

O grande apoio popular recebido por Bolsonaro tem sido suficiente para que não ele fique paralisado, e faça alguma coisa contra as escandalosas ações antidemocráticas do STF; ou não faça nada, se for o caso, em cumprimento da Constituição. Só está faltando coragem.

I could report many more cases of abuse committed by the Brazilian Supreme Court of Justice, but my intention is not to tire readers with this article, but it gives an idea of ​​what has been happening in our country lately. Well, if there is a dictatorship in vogue in Brazil, it is not exercised by Jair Bolsonaro. The immense popular support he has received has been enough for him not to be paralyzed, and to do something against the scandalous anti-democratic actions of the STF, or do nothing, if that's the case, but always in compliance with the Constitution. The President is just lacking courage.
